1. Eligibility
You must be at least 18 years old to create an account or use ayvia. By creating an account or using the service, you represent that you are at least 18 years old and legally capable of entering into these Terms.
2. About ayvia
ayvia is a general wellness technology platform designed to help users organize and understand information relating to nutrition, hydration, physical activity, workouts, habits, weight, goals, progress and other wellness-related activities. ayvia also includes AI-powered features that may generate informational responses based on information users provide.
3. Your Account
Certain features require an account. You agree to provide accurate information and keep your login credentials secure. You may not impersonate another person, create an account using information you are not authorized to use, or permit unauthorized access to your account.
4. Wellness and Medical Disclaimer
ayvia does not provide medical care. Nothing provided through ayvia constitutes medical advice, diagnosis, treatment, nutrition therapy, mental-health treatment or another professional healthcare service.
Any calories, macronutrient targets, hydration suggestions, exercise information, weight information, goals, progress indicators, trends or other wellness outputs are estimates or informational tools and may not be appropriate for every individual.
5. Emergencies
ayvia is not intended or designed for emergency use. Do not rely on ayvia or Ask ayvia to determine what to do during a medical or mental-health emergency. If you believe you or another person may be experiencing an emergency, contact local emergency services or an appropriate qualified professional immediately.
6. Artificial Intelligence
Certain features use artificial intelligence. AI-generated outputs may be inaccurate, incomplete, misleading, outdated or unsuitable for your individual circumstances. You are responsible for evaluating information before relying on it.
AI-generated responses should not be interpreted as professional medical, nutritional, psychological, legal, financial or other professional advice.
7. User Responsibility
You remain responsible for decisions you make based on your use of ayvia. Use reasonable judgment when setting goals, entering information, interpreting progress and acting on information produced by the service.
8. Food, Nutrition, Calorie and Activity Information
Food, nutrition, calorie, macronutrient, hydration, workout, activity and similar information may be based on user entries, calculations, databases, estimates, algorithms or AI-generated interpretations. Such information may contain errors or vary from actual values.
9. Social Features
ayvia may allow you to search for other users, send or receive friend requests, participate in shared challenges, share certain progress information and display profile information. You may not use social features to harass, threaten, abuse, impersonate, exploit, stalk or unlawfully target another person.
10. Profile Photos and User Content
You retain ownership of content you submit to ayvia, including profile photos and other user-provided content, subject to rights necessary for us to operate the service. By uploading content, you grant ayvia a limited, non-exclusive license to host, store, process, reproduce and display that content solely as reasonably necessary to provide the service.
11. Acceptable Use
You may not use ayvia to violate applicable law, infringe another person's rights, gain unauthorized access to systems or accounts, distribute malicious code, interfere with ayvia's operation, scrape data through unauthorized automated means, reverse engineer the service except where applicable law expressly permits it, misuse AI functionality, harass other users, create fraudulent accounts or bypass security measures.
12. Intellectual Property
Except for content submitted by users and third-party materials, ayvia and its associated software, source code, design, user interface, visual identity, graphics, logos, trademarks, text, features and other proprietary materials are owned by or licensed to the operator of ayvia and are protected by applicable intellectual-property laws.
13. Feedback
If you voluntarily provide suggestions, ideas, beta feedback, feature requests or other feedback concerning ayvia, you permit us to use that feedback to develop, improve, operate or market ayvia without an obligation to compensate you.
14. Beta Features
Certain versions or features may be offered as beta, preview, experimental or pre-release functionality. Beta features may contain bugs, errors, interruptions, incomplete functionality or data-loss risks and may change or be removed during development.
15. Third-Party Services
ayvia relies on certain third-party service providers and technologies. These may include Apple, Supabase, OpenAI, Expo and other providers used to operate, host, distribute, secure or improve the service. Third-party services may be subject to separate terms and privacy policies.
16. Apple App Store
If you download ayvia through Apple's App Store or TestFlight, your use of those Apple services is also subject to Apple's applicable terms and policies.
17. Paid Features and Subscriptions
ayvia does not currently offer paid subscriptions. If subscriptions or paid functionality are introduced, applicable pricing, billing frequency, renewal terms, trial terms, cancellation instructions and other required information will be displayed before purchase.
18. Account Deletion
You may initiate deletion of your account through ayvia's account settings. Deleting an account may permanently remove account information, wellness history, social information and other associated data, subject to legally permitted retention and reasonable technical processing periods.
19. Suspension and Termination
You may stop using ayvia at any time. We may suspend, restrict or terminate access where reasonably necessary because of a material violation of these Terms, suspected fraud or abuse, security concerns, legal requirements, risks to other users or discontinuation of the service.
20. Availability and Changes to the Service
We may modify, update, add, remove, suspend or discontinue features as ayvia evolves. We do not guarantee uninterrupted or error-free availability.
21. Disclaimer of Warranties
To the maximum extent permitted by applicable law, ayvia is provided on an "as is" and "as available" basis. We do not guarantee that the service will always be available, error-free, accurate, secure or suitable for every user's circumstances. We do not guarantee particular fitness, wellness, weight, health, performance or other outcomes.
22. Limitation of Liability
To the maximum extent permitted by applicable law, the operator of ayvia will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from or relating to use of the service. Nothing in these Terms limits liability where such limitation is prohibited by law.
23. Indemnification
To the extent permitted by applicable law, you agree to be responsible for claims, losses or expenses resulting from your unlawful misuse of ayvia, infringement of another person's rights or material violation of these Terms. This provision does not apply where prohibited by applicable consumer-protection law.
24. Governing Law
These Terms are intended to be governed by the laws of the State of California, without regard to conflict-of-laws principles, except where applicable consumer law requires otherwise. This draft does not include mandatory arbitration or a class-action waiver.
25. Changes to These Terms
We may modify these Terms as the service changes. If changes are material, we may provide notice through ayvia, our website, email or another reasonable method.
